SPECIFIC RENTAL CONDITIONS
Article 1 - Ownership
Our supplies are, wherever they are located, our property and cannot be transferred or seized and cannot be the object of any agreement with third parties.
Article 2 - Duration of the lease
The rental period is equal to the number of calendar days between the first working day following the day of dispatch from our premises and the last working day preceding the day of return to our premises, inclusive. The minimum rental period is one day. Unless otherwise agreed between the parties, the customer is obliged to return the equipment on the agreed date. If the equipment is not received at our premises on the agreed date, the extra days will be invoiced until the day before the actual delivery to our premises.
Article 3 - Rent
Rentals are determined by two rates: a flat rate for the first day of rental, plus a daily rate for each additional day. Rentals are firm and definitive for the entire duration of the rental period as defined in the contracts and any amendments thereto, unless the VAT rate changes. Rentals are due until the equipment is returned (including in the event of loss or theft).
Article 4 - Cancellation or breach of contract
In case of cancellation of an order, no fee will be charged to the Customer if Clean Air Engineering Europe is notified at least 5 days before the scheduled departure. If the cancellation occurs between 2 and 5 days before the planned shipment, a fixed charge of 10% of the order will be applied, if the cancellation occurs within 48 hours before the shipment the fixed charge will be 30% of the order. Finally, if the cancellation occurs after the shipment, the rental will be invoiced according to the contract until the equipment is shipped. Thereafter a penalty of 50% of the rental rate per day for the period until the end of the scheduled order.
Article 5 - Return of equipment
The extension of the rental period is only possible with the express agreement of Clean Air Engineering Europe.
The customer commits himself to decontaminate any equipment presenting a risk of contamination during the rental (nuclear, mercury, asbestos, bacteria...) before its return.
At the end of the contractual rental period, the Customer must return all the equipment, accessories and documentation in the same conditions as at the outward journey, using the packaging provided by Clean Air Engineering Europe. Upon receipt, Clean Air Engineering Europe has a period of five (5) days to inform the customer of any damage found on the equipment and to communicate the list of missing items (packaging material, fittings, tubes, accessories, manuals, software supports, etc.). Upon receipt of this list, the Customer has eight (8) days to find and return the missing supplies. After this period, he will be invoiced at the replacement price of these supplies.
Article 6 - Transfer of risk
For the entire duration of the rental period, the Customer shall be liable in the event of total or partial destruction, deterioration, loss or theft of the supplies, whatever the cause, including in the event of force majeure or an act of God. The user of the rented supplies is deemed to have the technical competence required to use and operate the rented equipment. Any damage caused by the Client or his representative upon return of the supplies shall give rise to repair or, if necessary, replacement at the Client's expense. In the event that the equipment is stolen during the rental period, invoicing will continue until the equipment is reimbursed or replaced.
Article 7 - Use of equipment
During the rental period, Clean Air Engineering Europe provides the Customer with the following: the device and a user manual. The customer is strictly obliged to follow the mentioned instructions. Failure to do so may result in damage to the equipment. The customer will be responsible for any repair costs incurred.
Article 8 - Special cases
In the case of particularly expensive equipment, Clean Air Engineering Europe reserves the right to ask its customer to provide a deposit or a lump sum insurance.
